Sindh High Court Summons Chief Secretary over Illegal Occupation of German School

KARACHI: The Constitutional Bench of the Sindh High Court (SHC) has expressed severe displeasure over the failure to recover the German School in Orangi Town from illegal occupation, summoning the Chief Secretary of Sindh and the Deputy Commissioner (DC) West to appear in person.

A two-member bench, headed by Justice Abdul Mobeen Lakho, heard the petition regarding the illegal lease and encroachment of the educational institution.

Case Background & Court Observations During the proceedings, the petitioner’s counsel, Saeed-uz-Zaman Advocate, informed the court that the SHC had previously issued clear directives in 2024. The court had ordered the immediate cancellation of illegal leases, the removal of all encroachments from the school premises, and the formation of a committee comprising local notables to oversee the school’s operations.

Judicial Resentment When questioned about the lack of progress, the Section Officer requested more time to implement the orders. Justice Lakho rejected the plea for further delay, remarking that the continuous pursuit of extensions is detrimental to public institutions.

“Government institutions are being ruined because of your negligence,” the Justice remarked. “The failure to implement judicial orders erodes public confidence in the judiciary.”

The Litigation History The case dates back to 2017, when Master Yunus Masih first moved the court against the illegal occupation of the German School, a vital educational asset for the Orangi Town community. The court has now adjourned the hearing, mandating the presence of the Chief Secretary Sindh and DC West to explain the non-compliance.
