KARACHI: The Sindh High Court has issued a written order on a petition challenging the judicial commission and seeking the formation of a Joint Investigation Team in the Mir Raza case. The court has summoned the Advocate General Sindh, Prosecutor General Sindh, and Deputy Attorney General to assist the bench during the next hearing scheduled for August 31. The primary focus of the court is to examine its own legal boundaries regarding whether it holds the jurisdiction to directly order a JIT, oversee ongoing investigations, or alter the reporting process without a formal gazette notification under the Sindh Tribunals of Inquiry Ordinance, 1969.
The legal battle stems from a petition filed by Mir Raza’s family, who alleged severe flaws in the initial investigation conducted by the Ferozabad Police. According to the petition, the crime scene was not preserved in time, witness statements were delayed, and electronic devices were mishandled, creating and promoting a premature suicide narrative. However, post-mortem anomalies prompted a court-ordered exhumation and examination by a Special Medical Board, whose final chemical and medical reports entirely ruled out the possibility of suicide. Furthermore, the petitioners accused the former investigation team of tampering with or destroying evidence, while noting that the current team has failed to identify any suspects and has requested additional time to submit the challan. The court is now carefully weighing whether it has the legal authority to form a JIT and issue binding supervisory commands over the investigation.
